Illegal Measure 37 Construction in Marion County


Laack_measure_37_subdivision On Monday September 17, D8 Caterpillars started bulldozing a road for a massive Measure 37 subdivision in Marion County. The claim was never approved by the county, but the claimants - Leroy L. and Jean R. Laack, M. Duane Rawlins, Greg M. Eide, Andrew A. and Margaret Rainone – ignored this detail, and hired North Santiam Paving to build the road. Construction began that Monday morning.

Concerned neighbors rushed to inform county officials that the claim was illegal, and construction was halted, but not before quite a bit of un-permitted road building took place on high-value Oregon farmland....(read the full story here)

Click for Maps of Measure 37 claims One of the sneaky “genius” features of Measure 37 is that it was structured in a way that made it very difficult to track its true impact on the Oregon landscape.  Claims could be filed in multiple jurisdictions, in different formats, with differing levels of detail.

Well, just in case there was any doubt of the terrible damage in store for Oregon’s farmland, forests, water resources and quality of life, here it is in living color.  We have compiled the location of claims of 100 acres or more and plotted them across the Oregon map, so you can see where the damage will be done.  And remember:  these are just the claims of 100 acres or more.  There are literally thousands of smaller ones across the state.

One of the reasons that Measure 49 is so important is that it distinguishes between these huge, disfiguring developments and those claims where people truly just want to put a few houses on their land for their kids or their retirement.  Measure 49 will stop the big development claims where they simply don't belong, while protecting property rights, and property value, for everyone else.

The claims indicated by purple dots on these maps are only those 100 acres or greater in size. There are literally thousands of smaller claims across the state. Combined, there have been over 7,500 Measure 37 claims filed on more than 750,000 acres. Most claims are on property that before Measure 37 was protected forest or farmland. To date, demands for compensation under Measure 37 total more than $20 billion dollars.

The Truth Behind The Bitzs' Claims


Jerry and Sandy Blitz are featured in a "Stop 49" mass mailer, where they state, " We told our kids we would give our property to them...we'd like to keep our farm for future generations." The truth is that, under current zoning laws, the Blitzs can divide their property into seven lots, or keep them intact as a farm, regardless of Measure 37 or Measure 49. The issue lies in Jerald V. Blitz's claim in Washington County where he is seeking to "subdivide and build homes" on 36.93 acres of zoned Agriculture and forest District (AF-5).

Fred and Teresa Netter are Deceptive Spokespeople for "Stop 49"


Nettermeasure49 The Netters say: "If Measure 49 passes, we'll lose the value of our property. We want to see the tradition go on... we want to farm."

This statement is patently false. The Netters filed a Measure 37 claim for a 60-lot housing subdivision on their 98 acres of exclusive farm use land. The state denied the Measure 37 claim because the land was already protected farmland when Fred Netter acquired it in 1977.

The Truth About "No On 49" Spokeperson Olivella Wilcox


Olivella Wilcox filed a Measure 37 claim to build up to 16 new dwellings on her 8.32 acre property - which is designated Rural Residential Farm Forest (RRFF-5) - in Clackamas County. Olivella Wilcox had demanded $500,000 to $1,050,000 in compensation.
